Common Causes Of Birth Injuries

You may have a case if your child’s birth injuries are due to a lack of oxygen (asphyxia or hypoxia), the improper use of forceps, the improper use of vacuum or a delay in performing a cesarian section:

  • Asphyxia/Hypoxia occurs when an infant does not receive oxygen before, during or immediately after birth. Without oxygen, the cells in the body cannot function properly and acid builds up in the cells, potentially causing permanent injury to the baby. The severity of injury to the baby depends on the duration and severity of the asphyxia before treatment was administered. Asphyxia/Hypoxia during childbirth can be caused by a tangled umbilical cord, infection or damage to the placenta. If hypoxia is not quickly addressed, the child can develop chronic mental and physical disabilities.
  • Forceps are large clamps that are used to turn the baby into a proper direction during delivery. Forceps often cause injury such as Erb’s Palsy when they are placed on the wrong part of the baby’s head or if used at the wrong stage of labor. If your treating doctor used them incorrectly due to inexperience or carelessness, this can cause severe injuries. Babies may experience skull fractures, brain injury, fractures internal bleeding and blood loss.
  • Vacuum extractors use a soft plastic cap to suction the baby during each contraction, in order to help move it along the birth canal. Unfortunately, they are known for causing a wide range of problems when used incorrectly. These include severe swelling of the scalp and bleeding between the skull and the scalp that can lead to permanent brain damage and death.
  • Delay of cesarian section: In cases where a C-section is not properly recommended or the doctor waits too long to perform surgery, a bad outcome can occur unnecessarily. Negligent errors in these cases may constitute malpractice. Emergency C-sections are ordered if the child is suffering from fetal distress.
