John Burnett prosecuted a medical malpractice – cerebral palsy trial against an obstetrician and a hospital for failure to timely detect placental abruption/fetal distress and timely intervene via C-section, resulting in cerebral palsy and moderate mental impairment. The jury awarded $15,000,000 for the child and $2,000,000 for the parents. A post-trial Motion for Pre-Judgment Interest resulted in a judgment of $32,000,000. The case resolved for a confidential amount after oral argument in the appellate court.
BIRTH/BRAIN INJURY VERDICT – $8,583,000
Howard E. Skolnick represented the Plaintiffs in a medical malpractice suit against MetroHealth Medical Center, and after nearly a three-week trial, the jury returned an $8.5 million verdict. In this case, the child suffered an irreversible brain injury resulting in the diagnosis of cerebral palsy due to substandard medical care.

In Re: L.M. etc. vs. the United States of America
Howard E. Skolnick represented the Plaintiffs in a medical malpractice federal tort claim lawsuit. This action was pursued in Federal District Court in Toledo. It was the plaintiffs’ claim that the failure of the nurses to report to the obstetrician the presence of maternal fever was decisive in the obstetrician’s management of labor, as well as whether or not to have the neonatal resuscitation team at the time of delivery. It was plaintiffs’ position L.M. (baby) suffered from lack of ventilation and perfusion after the delivery for approximately three minutes until she was intubated by the neonatal nurse. The obstetrician indicated had he known of the maternal fever, he would have suspected an infection and offered a C-section 55 minutes prior to the actual delivery during which time there was stress on the fetus as reported by the fetal heart tracings. As a result of these delays, L.M. suffered hypoxic-ischemic encephalopathy and was diagnosed with cerebral palsy including spastic quadriplegia, profound cognitive loss as well as loss of vision.
TRUCK ACCIDENT VERDICT – $2,368,000
Represented a commercial truck driver for post-traumatic stress disorder sustained when a motorist intruded into his lane of travel, causing him to veer to his left to avoid a collision and then attempt to get his rig back into his lane of travel. After avoiding the collision, the driver was unable to prevent the rig from tuning onto its side and sliding into a wall adjacent to the highway. After the rig collided with the wall, the driver was trapped in his seat for about ninety minutes. During this time, the driver smelled the overpowering odor of diesel fuel, which had spilled onto the highway. Aware of the very real threat of a fire from the spilled diesel fuel, he valiantly and steadfastly maintained his composure until rescued. A previously very active, bold man, the driver became virtually housebound secondary to post-traumatic stress disorder. The jury awarded him $2,368,000.
